Westbury restaurant granted 30-day extension on special use permit renewal

A public hearing for an Italian restaurant to renew its special use permit for cabaret usage will continue at a later date, because the owner and his son were not present at the meeting.

The initial hearing began during the Village of Westbury’s Thursday, Oct. 1 board meeting, and is set to continue during the village’s nect meeting on Nov. 5. Dennis Cook represented the restaurant, 081 Cena, which has had numerous noise complaints filed against it, Mayor Peter Cavallaro said.

“Your client can’t figure out how to comply with some very basic, simple requirements,” Cavallaro said. “Apparently, there are DJs who are not supposed to be there, who are supposed to only be in-house while operating their sound equipment.”

The restaurant renewed its special use permit for cabaret usage last year and was issued four-month probationary permits, including one on May 15, 2025, and another on Oct. 2, 2025.

The May 2025 permit included a stipulation that the permit could be revoked if “more than two reasonable, substantiated and corroborated complaints were made,” the Press previously reported.

During the Oct. 1 meeting, Cavallaro said the most recent complaint came from a resident earlier that day, who sent recordings of the establishment playing music outside of its operating hours, which are 4 p.m. to 10 p.m. from Tuesday to Thursday, 12 p.m. to 11 p.m. on Fridays and Saturdays, and from 1 p.m. to 9 p.m. on Sundays.
